Cancellation procedures: operator, resort or agency?
You booked through someone and need to know who to call when a boat does not sail.
The first call goes to whoever sold you the boat transfer. For most packages that is the resort or the agency, and for a boat ticket you bought yourself it is the operator. The trouble is that the answer is not always on your booking, so ask before you pay who handles a cancellation and write down the name and number.
For the full question list, read what to ask about cancelled boat transfers. For who decides the sailing, see who decides a boat will not sail.
Who do you call, depending on where you booked?
| You booked through | First call | Also ask |
|---|---|---|
| The resort, transfer included | The resort | Which operator runs the boat |
| An agency or tour company | The agency | Whether it handles rebooking itself |
| A boat operator directly | The operator | How to rebook or refund |
| An online platform | The platform, then the supplier | Whose terms apply |
| A mix of sellers | Each for its own part | Who connects the pieces |
If you are unsure, send one message to the seller you paid and ask: “If the boat is cancelled, who do I contact first, and what is the procedure?”
What can each party realistically promise?
The operator can tell you whether its boat will sail and when the next one goes. The resort can tell you what it does with your room and meals. The agency can tell you what it will do for your whole package. None of them can promise the weather, and none should promise what it does not control.
For Sipadan, permits are booked by registered operators through Sabah Parks, with a 50 percent deposit and a published cancellation scale [3]. That shows how an operator can be the party that holds the deposit rules. Read who is responsible: agency, resort, boat operator or us for the shared picture.
How do you check an agency is licensed?
The tourism ministry runs an online licence check, searchable by company name or licence number, according to Sabah Tourism and Bernama [1]. The page returned an error when we tested it, so verify the live address on the ministry’s website before you rely on it [1]. Suspected unlicensed activity can be reported through the ministry’s complaints system [2].
A licence does not guarantee a refund. It does tell you that you are dealing with a registered seller, which helps if you later need to complain.
What should the seller put in writing?
- Who is my first contact on sailing day, with a phone number?
- What is the procedure if the boat is cancelled on the way in or out?
- Do you handle rebooking and refunds, or do I deal with the operator?
- Within how many hours will you reply?
- What happens to my deposit?

What if nobody takes responsibility?
Start in writing and keep the thread tidy. Include your booking, the cancellation message and your receipts. A consumer claims tribunal hears claims up to RM50,000 within three years, with exclusions for personal injury and some sectors [4]. Read who pays when a connection fails and keeping receipts and screenshots for a transfer dispute.
A better fit if…
Asking this now suits you if you book through more than one seller, since pieces can fall between them. It matters less if one resort sells everything and writes the terms clearly. In that case, one question is enough: who do I call, and what do they promise?
Common questions
Who do I contact if my boat is cancelled?
Contact whoever sold you the boat transfer, usually the resort or the agency, since they hold your booking. If you bought the boat ticket yourself from an operator, contact the operator. Ask before you pay who the first contact is on the day, and write down a name and number.
Is the agency responsible for a cancelled boat?
It depends on the terms you accepted and on what the agency sold. We cannot say in general. Ask the agency in writing what it does when a transfer fails, and whether it handles rebooking, refunds or only passes your message on.

Can I complain if nobody takes responsibility?
Start in writing with the seller. A consumer claims tribunal hears claims up to RM50,000 within three years of the claim arising, though personal injury and some sectors are excluded. Keep your booking, receipts and messages from the start.
